Florida Woman Awarded $225K in Medical Malpractice Suit
An Ocala, Florida jury recently awarded a woman $225,000 in a medical malpractice lawsuit. The suit had alleged that both Dr. Jamal Fakhoury and Dr. Ross Dumbadse failed to order important brain examinations and that the two also did not obtain the correct medical records before treating the woman.
Donna Kern, the patient in question, began seeing the doctors at the clinic near the end of 2000 after a car accident left her in a lot of pain. It wasn’t until 2002, however, that an MRI diagnosed the woman with spinal cord compression, a very serious condition that gets worse over time. The doctors should have ordered the MRI much faster than they had, court documents have shown.
Henry Valenzuela, the attorney for Kern, stated that the jury’s award was proof that the doctors were negligent in failing to order the tests in a timely manner. Valenzuela stated that the doctors were the first step in Kern’s ability to recover from her injuries and their failure was an important setback in the woman’s healing.
