Lakin Approves Plan for Missouri Medical Malpractice Coverage
Scott Lakin, Director of the Missouri Department of Insurance, has authorized a state-sponsored insurance plan to provide medical malpractice coverage for Missouri physicians. Lakin issued a formal declaration stating that Missouri medical malpractice is not “reasonably available” to some physicians and called for a joint underwriting association (JUA) to issue additional coverage. Prior to the issue of additional policies in June 2004, Larkin is calling for some reforms to the 1974 JUA law, which includes such stipulations as a governing board consisting of eight insurance company executives with no representation from doctors or other health care providers. The state is also working to compile a comprehensive data pool of doctors, cases, and premiums in Missouri, as most Missouri medical malpractice companies do not have more than half of the data they need to set rates in that state. The rates will also be used by the JUA, which is intended as a short-term solution to the Missouri medical malpractice insurance problem.
