$8 million verdict for failure to diagnose breast cancer lawsuit
A Dallas County jury awarded a woman and her husband $8 million to conclude a failure to diagnose breast cancer lawsuit. The woman visited her primary care physician for an annual checkup in September 2000 and had no trace of breast cancer. When the woman discovered a lump a month later, she visited her obstetrician and had a mammogram and sonogram performed. Test results were negative.
When the lump was still present six months after that examination, the doctor told her it was benign. Just two months later, the woman had back pain and visited her primary car physician and a breast surgeon to find she had cancer in her spine and hip after a series of tests were performed. An additional mammogram and sonogram also revealed the woman had breast cancer as well.
The medical malpractice lawsuit was filed with claims that the doctors and medical professionals in charge of examining her were negligent and failed to uphold accepted standards of medical care.
