Most Recent Data Released by the National Center for State Courts

Recent data that has been released by the National Center for Sate Courts (NCSC) has found that between 1992 and 2001 the medical malpractice filings trend per 100,000 population has fluctuated only minimally and has had an overall 1% decrease in per capita filings. In five years of data covering 17 states the NCSC discovered that in 7 of the states the filing decrease was even more drastic with only one of those seven states having a medical malpractice damage cap.

The American Medical Association described 5 of those states to be in a “full blown crisis,” false declarations considering the evidence showing the decreasing medical malpractice claims. Seven states that have experienced a decrease in overall medical malpractice filings that have been examined by the NCSC are as follows:

-Missouri medical malpractice filings between 1997-2001 has seen a 2% decrease.
-New York medical malpractice filings between 1997-2001 has seen a 3% decrease.
-Connecticut medical malpractice filings between 1997-2001 have seen a 4f% decrease.
-New Jersey medical malpractice filings between 1997-2001 has seen a 9% decrease.
-New Hampshire medical malpractice filings between 1997-2001 has seen a 15% decrease.
-Oregon medical malpractice filings between 1997-2001 has seen a 37% decrease.
-Minnesota medical malpractice filings between 1997-2001 has seen a 44% decrease.
