Jury Awards $3 Million to Cancer Misdiagnosis Victim

Two physicians involved in the treatment of a Pennsylvania woman were each found partially liable for damages the woman suffered as a result of a cancer misdiagnosis.

Michelle Kachurak’s medical problems began in late 2000, when she experienced vaginal bleeding. Dr. Karen Cooper of Forty Fort, Pennsylvania started Kachurak on chemotherapy after a positive hCG (human chorionic gonadotropin) blood test result, but without any further investigation.

Unnecessary Treatment

Kachurak later found out that a urine test for hCG could better determine whether she had cancer that would justify undergoing chemotherapy. When Kachurak had this urine test done, the result was negative, but Dr. Gazi Abdulhay of Lehigh Valley reported that the test result was positive, and Kachurak’s chemotherapy sessions continued until she was given another urine test.

Altogether Kachurak underwent 12 rounds of chemotherapy she did not need.

The medical malpractice action filed by Kachurak’s lawyer was heard before a Pennsylvania jury, which found each of the doctors 50% liable for the unnecessary chemotherapy. In early May 2007, the jury awarded Kachurak $3 million in damages.
