Malpractice Suit against Ex-Eye Surgeon Settled
A malpractice lawsuit, filed against a former eye surgeon, was settled out of court in Tucson, Arizona.
The attorney for Eduardo and Delia Valenzuela said the terms are confidential, but the lawsuit, which was scheduled to go to trial next week, was settled on Wednesday.
The Valenzuelas sued the ex-surgeon, Bradley Schwartz, on their son’s behalf in January of 2004.
Their son was born in 1994 with congenital cataracts.
According to the Valenzuelas, Schwartz performed an intraocular lens implant on the boy in November of 2004. Schwarz negligently failed to notice that the boy’s retina was detached six months after the operation. By the time another doctor diagnosed it, it was too late to correct it. The child lost vision in that eye.
Schwarz never told the family of his addiction to prescription medication, and the Valenzuelas feel his drug problems could have been a cause of the mistake.
Schwarz was also convicted of conspiracy to commit first-degree murder in the killing of a former medical associate who was slain in 2004.
Schwarz’s medical license has been revoked and he has received a life prison sentence with the possibility of parole after 25 years.
