Parents Awarded $11.4M for Birth Injuries
On Oct.17 in Prairie du Chien, Wisconsin, a Crawford County jury sided with Chad and Amy Jelinek, parents of a boy who suffered birth injuries. After a three-week-long trial, the jurors awarded the Jelineks $11.4 million to be paid for by the Gunderson Lutheran Medical Center in La Crosse, Wisconsin, where their son Laine was born in 2005.
Substandard Medical Care by a Nurse and Nurse Midwife
The Jelineks are residents of Eastman, Wisc., a very small town about 50 miles south of La Crosse, near the Mississippi River. Their 2006 lawsuit alleged that negligent, substandard medical care by a nurse and a nurse midwife during Laine's birth caused his permanent brain damage.
Compensation for Extreme Losses
After the jury's verdict, Jeff Goldberg, the Jelineks' attorney, stated that the award barely compensates Laine and his family for their losses, but that the money will improve the toddler's life. The Gunderson Lutheran Medical Center issued a statement contending that the care Laine received during his birth was appropriate.
