Malpractice Lawsuit Filed By Lesbian Couple
A misdiagnosis medical malpractice lawsuit filed by a lesbian couple on Tuesday marks the first of its kind since Connecticut enacted its civil unions law last year.
Margaret Mueller and Charlotte Stacey, domestic partners for 21 years, were joined in a civil union on November 12, 2005. They are both suing two doctors who are accused of treating Mueller for the wrong type of cancer while the real cancer spread.
“I think it’s any patient’s worst fear that everything they’re doing to treat themselves is for naught,” said the couple’s attorney Joshua Koskoff.
Mueller was diagnosed with ovarian cancer and underwent years of needless and devastating chemotherapy for its treatment. She actually had cancer of the appendix, which was all the while metastasizing.
Because of the state’s civil union law, Stacey can also sue the doctors for loss of consortium - or harm to her relationship. Previously, only married partners could seek compensation for this type of loss.
“The victims of malpractice are rich and poor, gay and straight, Democrat and Republican. If that’s the case, the law shouldn’t discriminate in the way its treats victims of malpractice,” said Koskoff.
