Widow Sues Nursing Home over Husbandís Death
The widow of a 52-year-old man who died in a nursing home has filed a wrongful death lawsuit alleging nursing home negligence.
Sheila Myers filed the lawsuit claiming that her husband Leslie Simpson did not receive adequate treatment at the Shepherd of the Valley Care Center and died as a result.
The Lapse in Care
According to the suit filed by Myers’ attorneys Robert Tiedeken and Jeremy Michaels, Simpson received deep suctioning treatment for two days beginning Dec. 5 for a mucus plug stuck in his trachea. He was transferred to Shepherd of the Valley Care Center on the 6th, the suit states.
According to SVCC staff notes, nurses checked on Simpson at least four times on Dec. 7, but the nurses never performed the required “trach care,” the complaint states.
At 3:30 a.m. on Dec. 8, a nurse came into Simpson’s room and found him splayed on the bed with no vital signs, the suit states.
“His legs and arms were sprawled apart and his bed covers disheveled, evidencing the patient’s apparent distress,” said the complaint.
According to the suit, Simpson was pronounced dead at that time.
“Had appropriate and proper tracheostomy care and suctioning been performed by staff of the Shepherd of the Valley Care Center, Decedent Leslie Simpson would have survived,” stated the complaint.
An autopsy revealed that Simpson died from cardiopulmonary arrest, which resulted from a mucus plug in his tracheostomy tube. This plug should have been cleared.
Myers is suing for loss of future economic support, loss of companionship and funeral expenses, the suit states.
Simpson was survived by his wife, parents, a son, two stepsons, one stepdaughter, and a brother.
