$3M Settlement Reached in Medical Negligence Suit
The parents of a newborn who died shortly after birth as a result of a doctor’s negligence have settled a medical malpractice lawsuit for $3 million to compensate for their losses and suffering.
According to the suit, Renee Elmy was admitted to the hospital in August 2005 to give birth to her son. The lawsuit alleges the doctor, Michael Miller, incorrectly used forceps to deliver the infant causing him to sustain serious injuries that led to his death.
Allegedly, the amount of pressure used by Miller to deliver the baby caused severe damage to his liver and broke his skull in two places.
The medical malpractice lawsuit was initially filed against both the hospital and the doctor, but Geisinger was dropped as a defendant as part of the settlement.
About $500,000 of the settlement award will be given to the Medical Availability and Reduction of Error Fund, which is aimed at decreasing the number of medical mistakes that often lead to serious patient injury and death.
