Medical Malpractice Legislation Passed in TN

A legislation that is seeking to limit “frivolous” medical malpractice suits has recently been passed by House in Tennessee.

Supporters of the medical malpractice legislation say they’re happy and relieved to see that all their hard work over the past few years has finally paid off.

Changes Made in Tennessee

According to reports, House lawmakers voted 93-1 for the bill to be passed.

The new legislation will require defendants to be given 60 days notice before a suit is filed against them.

A similar bill was supposedly passed by Senate last year.

Fight for Bill

“It’s been a five year struggle on this legislation,” says Rep. Doug Overbey, the bill’s main sponsor. “It is gratifying to see a nearly unanimous vote on it, especially after last year.”

The current state law enables medical witnesses to come from any state that borders Tennessee but requires them to be experts on the medical standards of a similar community where the defendant doctor is practicing.

Rep. Rob Briley, who co-sponsored the new bill, argued that those rules make it too easy to discredit physicians who don’t know details about how a local hospital operates.
