Woman Awarded $8M in Pharmacy Error Case

A South Carolina woman was awarded almost $8 million in damages after a local pharmacy’s prescription error caused her to lose the use of her kidney.

After a two-week trial, the jury ordered Eckerd Corporation to pay Tiffany Phillips $7.7 million in compensation for her losses and suffering.

Case Details


In 2002, 23-year-old Phillips underwent a kidney transplant to replace the damaged kidney she was born with. After her operation, she went to Eckerd to fill a prescription for an anti-rejection medication.

According to the medical malpractice lawsuit, the drugstore didn’t carry enough of the drug, so the pharmacy technician placed a call to CVS to fill the prescription. As a result of a miscommunication between the two pharmacies, Phillips was ordered to take five times the amount of the drug than she should have.

Instead of 250 milligrams a day for three days, Phillips took 1250 milligrams of the drug, which caused her to experience severe kidney damage.

Phillips’ lawyer Ronnie Crosby claims this outrageous medical error has left his client with very few alternatives. She has already undergone two kidney transplants and is unable to have a third. Furthermore, she cannot use dialysis because of the overdose of the anti-rejection drug.

“This is it for her,” Crosby said. “The net result is this has reduced her life expectancy.”
