Couple Awarded $10 Million in Malpractice Suit
A Dallas Jury awarded a McKinney couple more than $10 million for damages suffered as a result of hospital negligence – one of the largest medical malpractice verdicts against a hospital in the county.
Tom Ivey, a 53-year-old investment banker, underwent surgery at Medical Center of McKinney four years ago that left him with a perforated esophagus. To repair the damage, Ivey had to undergo 11 surgeries including the removal of his esophagus.
Ivey has suffered numerous complications, spent a year on a feeding tube, and most likely will require lifelong medical care.
According to the lawsuit, Ivey’s injuries also negatively impacted his relationship with his wife. The jury awarded them both for their pain and suffering and Ivey individually for lost earning capacity and cost of medical care.
The original petition cited Dr. Mark Shea Henderson as responsible for the injuries Ivey suffered. The jury exonerated Henderson but found Medical Center of McKinney, part of Hospital Corporation of America, to be negligent.
Ivey ultimately seemed pleased with the verdict. “The evidence was laid out and they made their decision and I think it was the right one,” he said.
