West Virginia medical malpractice lawyers continue to debate issue

West Virginia medical malpractice debates continue to push on, as well as throughout the rest of the country. Some states have capped medical malpractice lawsuit damages in response to the “crisis” conditions that medical associations and the insurance industry have claimed exists. Trial lawyers have continued to argue that insurance industry is only trying to increase costs to make up for stock market losses. In West Virginia, the Medical Association was still successful in getting a $500,000 cap on most medical malpractice lawsuit damages. Capping medical malpractice damages would result in lower insurance premiums for doctors, medical associations claimed, but since the West Virginia capped damages went into effect, the lower insurance premiums have yet to come.
